What's Your Challenge?

Last week’s ILTA conference was better than ever. Although attendance was down considerably, I believe that less is more this year.

Fewer people means increased intimacy, more meaningful discussions and enhanced opportunities to create relationships and engage in a long, uninterrupted exchange of ideas.

This year, the people who were able to attend ILTA were clearly decision-makers and influencers, not lieutenants and junior professionals. Everyone came with specific purpose – to learn and engage in a meaningful senior-level exchange of ideas. Attendees and vendors alike could spend more time with key decision makers than in past conferences.

We attend ILTA to explore new technologies, work flows, processes, vendors and systems but at the end of the day, it’s about the people. The technology doesn’t create itself, sell itself or run itself. Workflow and process improvement can’t be canned, packaged or replicated without talented people involved in the technology’s inception, implementation and execution.

While at ILTA, I polled 100+ people on their greatest challenge entering the fourth quarter of 2009. Of these attendees, 20% said their greatest challenge is technology, 60% said it is process workflow and 20% said it is people. If 60% of the challenge is process workflow, isn’t that truly a challenge about people? Without the right people, you can’t originate, implement or execute the process or make informed technology decisions.

People come to ILTA for a variety of reasons. They want to learn about technology improvements, workflow and process improvements and new vendors. But, at the end of the day, it’s really about the people.

How time flies when you’re not writing a blog… It’s been two months since my last post, and it feels good to be back in the saddle.

As many of you know, The Cowen Group has been hosting regular Breakfast Roundtables in New York City that bring together top E-Discovery professionals and attorneys from the corporate and AmLaw space to discuss the evolution of critical trends in the industry.

Q2 Hiring Trends: AmLaw200 Ready to Rebound

The AmLaw Litigation Support/E-Discovery job market is poised for a rebound in the later part of 2009, which will extend through 2010. However, many law firms anticipate building flexibility into their hiring plans by relying heavily on Temp-to-Perm employees.

When surveying over 100 Litigation Support and Human Resource Managers, we found that 42% of the AmLaw100 report an increase in hours worked since Q2 2008. As a result, 31% anticipate adding temporary staff within the next 6 months. In the AmLaw Top 50, 70% anticipate adding temporary staff within 6 months. For the most part, permanent hires in the AmLaw 100 remain flat.

These trends reinforce a shift in the market that The Cowen Group has observed internally: permanent employees at AmLaw200 and AmLaw300 firms are expressing interest in temporary positions within the AmLaw Top 50. They see the transition from permanent to temp-to-perm as a chance to at with the best-and-brightest – firms which have best-in-breed technologies and the largest, most complex cases.

REINVENTING YOUR WHEEL

Good news:  The worst is over!

Hiring, not firing, is on the rise for Litigation Support and eDiscovery professionals!  The landscape for Litigation Support staffing, however, will be very different than years past.  Historically, the upturn in hiring after a meaningful national economic downturn is first seen in temp and contract hiring.

The Cowen Group is experiencing a significant increase in demand for temporary and contract staffing (NOT contract attorneys, but Lit Support staff).  When surveyed, 35% of firms in the AmLaw100 already indicated that their current Litigation/Practice Support staff is working into overtime hours.  As new cases come in, firms will need experienced talent to support increasing demands from internal case teams.

PROBLEM:  No PERM headcount. 

SOLUTION:  Hire “as needed” contract employees.  This trend will continue to grow exponentially in Q3 and Q4 of 2009 and likely into 2010.

So what does this mean for you?  Well, if you are working at an eDiscovery vendor or a tier 2 or 3 law firm… now is the time to reinvent yourself.  The most frequent question I get asked from individuals in the vendor community is, “How do I break into a major law firm?” 

According to Gartner's recent eDiscovery Vendor Market Analysis “by the end of 2008, there will be 25% fewer vendors claiming to have eDiscovery functionality."  25%!!  That means fewer jobs in the vendor community for project managers, analysts, specialists, EDD processors, and sales professionals.  Where will they go?  What will they do?

Exploring contract and temp-to-perm opportunities may be your best bet.  Yes, you may have to give up the benefits/perks of being a full-time employee.  Yes, we are placing vendor exclusive talent in long term temp-to-perm contracts, and yes, they are gaining invaluable experience.

The down-side to contract is obvious, but give some real consideration to the up-side:  You can make more money as a contractor.  You can gain experience with a variety of different cultures, business models, and technologies at various law firms – all the while searching for what will be the right fit for you long term.  You will have the opportunity to meet new people and thought leaders in the space.  You will be visible to a whole new community and network of professionals working within the AmLaw200.  As the old adage goes, it’s not just what you know – but who you know.

Contract staffing is going to increase over the next 12 to 24 months as demand begins to outweigh supply again.  This industry is reinventing itself… so should you!

Under the direction of the Litigation Support Manager, the Litigation Support Analyst is responsible for creating, maintaining, and troubleshooting litigation databases and computer imaging projects and is responsible for providing technical support for litigation support software applications.

  • Loading and extracting ASCII text data to/from litigation support software applications.

PROJECT MANAGER $95-125 NYC

The Project Manager (PM) will be responsible to plan, facilitate, execute and manage the implementation process of high profile, firm-wide technology projects with strict deadlines. The PM will be expected to “drive” all aspects of technology projects to include managing data, the documentation process, communication with the project team and stakeholders, recommendations for best practices and outside vendors, facilitating meetings with stakeholders, and teeing up issues for partners/decision makers in order to deliver projects on time. Stories from LegalTech...

 

The most prevalent story that I'm hearing at LegalTech 2009 is that E-Discovery is truly beginning to move left…something that Cheryl McKinnon does a great job of explaining in this article “Think Left”.

The Records Manager role is evolving into a role called Manager/Director of Information Compliance. Certified Records Managers with deep IT knowledge and an understanding of E-discovery will be a very hot career in 2009.

If the demand for Managers of Information Compliance takes off like it did for Litigation Support Managers back in 2004 and 2005 I expect salaries to jump 20% this year and 25% next year.

LegalTech 2009

 

For me, LegalTech has never been about the exhibitor floor with the latest and greatest technology.  It always been, and continues to be, about the educational sessions and the people.  I enjoy meeting and exchanging ideas with the legalists, technologists, business process gurus and innovators sharing their experiences and vision of the future.

I like to hear the insights of George Rudoy, Patrick Oot, Browning Marean, Deena Coffman, Craig Ball, Ken Withers, and other popular thought leaders as they share what they have learned over the past year. They understand the confluence of the law, business process, people management, legal technology and how to effectively implement these crucial aspects of E-discovery. Equally important are the up-and-coming thought leaders, individuals that bring a new and fresh outlook to the industry.

As the economy continues to dip further into a recession and the legal sector continues to experience layoffs, you need to remain active and intellectually engaged. You need to strengthen your current professional relationships and reach out to build new ones within the community. If you are not curious about the business of e-discovery and actively pursuing knowledge and new ideas, then you risk finding yourself on the layoff list. Managers will be looking to keep the best and the brightest if they are forced to cut headcount.

You can leverage conferences such as LegalTech to your advantage to stay abreast of industry trends and strengthen professional relationships. As I’ve said before, develop a game plan before the conference.  Take away at least one new idea from every each session you attend, meet at least one new person in each session, and remember to say hello and thank the panelists.  Introduce yourself to at least five new people every day at the conference and listen more than you speak.  These strategies will help you make the most of every conference.

Legal Technology Services Director $200-225K NY & DC

AMLAW Top 100 firm seeks a senior practice group/litigation support technical position. The candidate must possess a thorough knowledge of current hardware and software capabilities to implement, operate, and utilize computer systems for the support of all practice areas, as well as a high-level understanding of the litigation and e-discovery process. Strong leadership, teamwork, communication, organizational, business development, and project management skills required. Responsibilities:

As a Senior Consultant in the Discovery Services area within the Disputes & Investigations practice, you will be responsible for managing various types of projects involving electronic discovery and/or forensic investigations on behalf of our clients. Sales and marketing activities are broad-based and include prospecting, cold calling, networking, and public speaking. The Litigation Support Analyst provides administrative, technical, and operational integration of litigation support technology to the Firm's attorneys, litigation analysts, and paralegals.  Works both independently with supervision from senior staff and in a multi-user/multi-shift team environment to accomplish tasks in the most accurate and efficient manner.  Supports specialists and senior staff in the department on litigation support projects and in-house e-discovery and tasks.

ESSENTIAL DUTIES AND RESPONSIBILITIES include the following. Other duties may be assigned.

  • Examines electronic media for content, organization and type of information it may contain, and assists with the proper handling and storage of client data.
  • Loads data from electronic media onto network storage environment.
  • Processes ESI for e-discovery projects using applications, tools and utilities defined for the process workflow.
  • Creates document productions (paper, image, native format) in accordance with specifications for each project or matter, and assists with the exchange/sharing of data with clients, co-counsel, etc.
  • Supports quality control of all assigned tasks, including database loads, deliverables from outsourced projects, media creation and duplication, etc.
  • Assists with maintaining case summaries and tracking logs for production database projects.
  • Provides support for database end-users, including training, search assistance, troubleshooting, batch printing, etc.
  • Litigation Graphics: designs and creates case-specific graphics for use in legal briefs, as demonstratives, and for in-house educational programs; works with vendor to create and deliver blow-ups and other outsourced tasks.
  • Miscellaneous tasks as assigned, including:  data media duplication, data assessment, imaging (Tiff or PDF), spreadsheet manipulation, tiff blowback and native file printing.

QUALIFICATIONS 

  • Knowledge of the litigation process and an understanding of the use of technology to support litigation efforts.
  • Experience with LAW 5.0, Concordance/Opticon, LiveNote, and/or other litigation support tools, as well as with some/all of these additional tools:  MS Office (Access, PowerPoint, Excel), Outlook, Lotus Notes, Ipro, Trial Director, Sanction, RoboCopy, TextPad, etc.
  • Ability to multi-task, perform under tight time constraints, manage competing deadlines, self-check work, and respond swiftly and effectively to changing demands.
